A story on CNN about a recall of cat and dog food: Menu Foods sells under many names and at many stores (WalMart, Kroger (Smith’s), PetsMart, etc). From Susan Boswell: The following information is from Jan Gribble.
On Saturday, one of the local rescue groups held its annual meeting. The guest speaker was the captain of Field Services at the Albuquerque Animal Care Center. She is responsible for training and supervising the officers who write citations and investigate complaints.
High points of her talk -
At the current time, ACC officers have the ability to write citations and file criminal complaints. They do not have arrest powers and must work with APD if the charges are sufficient to warrant an arrest. Ms. Bruce is working on changing this as she wants ACC officers to be able to carry weapons and have arrest powers (this will require officers to complete the Police Academy)
She stated that the only exemption to the leash law was the use of a dog park. (However, the new animal law does not have a provision for dog parks which was in the ordinance replaced.)
According to Ms. Bruce, ACC is actively conducting “sting” operations trying to locate people selling animals without litter permits.
She said that there are currently discussions underway to have Bernalillo County adopt the city ordinance.
As of 04/10/07 , ACC will be hitting parks (both dog parks and non-dog parks) more frequently to enforce the law. ACC will be working with Parks& Recreation to do this. She said that anyone out in public with a dog will need to prove compliance with the law – license, spay / neuter and microchipping. ACC will impound any dog not spayed / neutered if the
owner has not purchased an intact animal permit and the owner will not be able to pay for a permit and get the dog back intact. She said that the city considered the six month period between the ordinance being enacted (10/10/06) and 04/10/07 was a grace period but that anyone not in compliance by 04/10/07 would be cited. When it was asked what steps the City was taking to inform the residents of the new law, she said that ignorance is not an excuse and citations would be issued whether the owner knew what was required or not. (The City has scheduled five community meetings at community centers this week to cover the new ordinance. However, to the best of my knowledge the only place these meetings have been advertised is on the ACC web site. I have seen no coverage in the media.)
Other citations will be written based on complaints called in. (Remember, under the new law ACC officers do not have to personally observe a violation to cite an owner.)
